Does your company comply with the obligations placed upon it by the Data Protection Act and the Privacy and Electronic Communications Regulations?

Are you aware that if your company processes personal information and it does not benefit from a notification exemption, it is required to notify to the Office of the Information Commissioner? Failure to notify is a criminal offence.

Are you aware that bogus agencies, posing as the Office of the Information Commissioner, are sending letters to companies informing them that they are committing an offence by not having a data protection notification and asking them for a cheque for £95? The letters do look official and many unsuspecting companies have unfortunately responded to these letters.

Are you aware that those individuals about whom you hold personal information have the right to request copies of that information from you? Are you also aware that you are required by law to provide that information to the individual concerned within the timescale of 40 days?
